Legal basis for child passport

Clause 1. Sweepstakes Organizer

CANARYFLY, S.L. (hereinafter, Canaryfly), with registered office at Gran Canaria Airport, Hangar L, P.O. Box No. 84, 35230 Telde, and Tax ID B-76013481, organizes an activity involving a “children’s passport,” whose prizes and terms are described in these legal terms and conditions.

Clause 2. Time Scope

The “children’s passport” will begin distribution from July 2025 until stocks last. The “children’s passports” will be delivered and stamped on board while supplies last and will remain valid for 1 year from the date of delivery, during which stamps may be accumulated. Prizes may be redeemed progressively as stamps are collected, and once the 1-year validity period has ended, an additional 3-month grace period will be granted to redeem prizes so that participants have a full year to collect all stamps.

Clause 3. General Participation Conditions

  1. Passengers within the infant and child categories aged 0 to 11 years inclusive may obtain the “children’s passport”.
  2. Participation must take place within the period indicated in Clause 2 of these legal terms and conditions.
  3. In general, any person meeting the described conditions may participate in the program. However, the following are excluded:
    - Employees of Canaryfly or its subsidiaries.
    - First-degree relatives by blood or affinity of the above.
  4. Canaryfly reserves the right not to award any prize to participants who cheat, alter, or disrupt the proper functioning and normal course of the program or who fail to comply with the conditions set forth in this document.

Clause 4. Free Nature of the Program

The “children’s passport” is free of charge and does not involve any payment by participants.

Clause 5. How to Obtain the Prizes

The “children’s passport” will be delivered on the child’s first flight, where the first stamp will be applied on board. One stamp will be applied for each flight taken, provided that the child travels. Stamps will not be applied to unrelated persons, parents, or guardians holding the “children’s passport” without the associated child traveling on board.

With the total of 9 stamps available in the “children’s passport,” participants may obtain up to 3 prizes. These prizes are awarded progressively: once the child collects the first 3 stamps, they will receive an inflatable ball, which can be collected at the company’s sales office. After collecting another 3 stamps (6 in total), they will receive one ticket to the Poema del Mar park. Finally, upon collecting 3 more stamps (9 in total), they may choose between Loro Parque or the Siam Park water park.

Clause 6. Prize Description

The prizes available in the program for children completing the required stamps are:

  • With 3 stamps: one inflatable ball.
  • With 6 stamps: one free ticket for 1 child + 1 adult to Poema del Mar.
  • With 9 stamps: one free ticket for 1 child + 1 adult to Loro Parque or Siam Park.

The prize does not include any expenses not expressly specified in these terms and conditions.

Delivery of the prize is conditional upon the winner complying with the conditions specified herein. Since participation is limited to individuals who have traveled on board Canaryfly, the winner must identify themselves by presenting an identity document. Canaryfly will inform the participant of the means through which such verification will take place and states that the document will only be used to verify the provided information. Any stored information related to this purpose will be deleted once it is no longer necessary.

Canaryfly reserves the right to automatically and without prior notice exclude any participant who is not complying with the participation conditions or who is misusing or abusing the activity.

Clause 7. Prize Conditions

  • “Children’s passports” are subject to availability and will be distributed while supplies last.
  • If, for any reason beyond Canaryfly’s control, the planned prize cannot be enjoyed or is unavailable, Canaryfly reserves the right to substitute it with another of equal or similar value.
  • The prize cannot be exchanged for cash or any other prize and is non-transferable.
  • Canaryfly is not responsible for how the winner uses the prize.
  • Canaryfly shall not be responsible for services provided by third parties related to the prize.
  • Canaryfly shall not be responsible for the proper enjoyment of the prize.
  • Commercialization and/or sale of the prize or the right to obtain it is prohibited.
  • Canaryfly reserves the right to declare the prize void if there are reasonable grounds to believe that a participant has violated any of these terms and conditions.
  • It will be an essential condition for prize delivery that the parent or guardian presents identification proving the identity of the winner and their own legal age.
  • The period for claims, obtaining stamps, and redeeming prizes ends 1 year and 3 calendar months after the date of delivery of the “children’s passport.”

Clause 8. Procedure for Prize Delivery and Redemption

1. Prize delivery and redemption will be carried out as follows:

1.1 Inflatable balls: The winner must visit the Canaryfly sales office at their airport with the “children’s passport” to redeem the prize.

1.2 Loro Parque or Poema del Mar ticket: The winner or legal guardian must send an email to marketing@canaryfly.es with photos of the child’s identification page and the corresponding stamped pages.

1.3 Siam Park ticket: The winner or legal guardian must send an email to marketing@canaryfly.es with photos of the child’s identification page and the corresponding stamped pages.

Clause 9. Data Protection

Canaryfly S.L., with Tax ID B76013481 and registered office at Gran Canaria Airport, Hangar L, Postal Code 35230, Las Palmas de Gran Canaria, as data controller, will process the data for the following purposes:

  • Identification and assignment of prizes: winners may be required to provide an identification document to verify their identity in order to enable the assignment of the prize. This data will be used solely for this processing purpose and not for any other purpose. Therefore, once the winner’s identity has been verified, the data will be deleted. The legal basis for this processing is the consent of the data subject or their representatives, as established in Article 6.1.a of the GDPR. The data will not be disclosed to third parties except where legally required.
  • Rights: we guarantee the data subject’s right of access, rectification, and deletion of their data, as well as the right, where applicable, to object to the processing of their data or request its portability or restriction. You may exercise your rights by sending your request to lopd@canaryfly.es or to the postal address indicated at the beginning of this document. You may request forms for exercising your rights or, if you prefer, download them from the website of the Spanish Data Protection Agency, www.aepd.es. Your request will be resolved within a period not exceeding 30 days from its submission. If you are not satisfied with the response received, you may lodge a complaint with the aforementioned Supervisory Authority. Clause 10. Modification, Suspension, or Annexes to These Conditions

Canaryfly reserves the right to make modifications or add annexes regarding the mechanics and prizes, provided they are justified, do not harm participants, and are duly communicated.

If this activity cannot be carried out due to fraud, technical errors, or any other reason beyond Canaryfly’s control affecting the normal operation of the activity, Canaryfly reserves the right to cancel, modify, or suspend it. Canaryfly may also suspend the activity for any reason, communicating this in advance through social networks, without participants being entitled to claim liability.

Canaryfly reserves the right to remove or exclude users who misuse the activity, commit fraudulent acts, or harm other participants. If Canaryfly or any professionally related entity detects anomalies or suspects illegal alteration of participation records through technical or computer procedures, or any fraudulent acts contrary to the transparency of the activity, Canaryfly reserves the right to exclude participants and withdraw prizes automatically and without explanation, while also exercising any applicable civil or criminal actions.

Clause 11. Acceptance of the Terms

Participation in this activity implies full acceptance of these terms and conditions and express submission to Canaryfly’s interpretative decisions. In the event of disputes between participants and Canaryfly regarding interpretation, the Courts and Tribunals of Las Palmas de Gran Canaria shall have jurisdiction, without prejudice to any applicable consumer protection laws.

Clause 12. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. Any claim related to the SWEEPSTAKES must be submitted in writing to Canaryfly, Attention: Marketing Department, at the following address: C/Monseñor Óscar Romero, A1, 2ºA, within thirty (30) days following the participation deadline of the SWEEPSTAKES.
